Why Are Patent Laws Required?

Patent is a type of intellectual property right that provides an inventor sole rights over his inventions along with the process through which that product is manufactured. It encourages novel ideas and inventions and is therefore considered very important in the commercial world.

When an inventor invents an innovative and exclusive product that can be marketed for a profit, he would not want others to take advantage of his creation, and the time and efforts invested in it. However, when you discuss your invention in public or engage in promotion of the product, some infringement of your right over your invention is likely to happen. It is in such instances that patent laws come to your help.

Patent laws grant the inventor legal ownership over his invention and processes thereto along with the right of exclusive usage for a particular span, after which any other person can make use of that invention for his or her own gain. This allows the inventor to get substantial returns on his efforts in a lawful manner and also to prosecute any person who is found violating his rights over the product or the process.

Another aspect that adds to the importance of patents is that they help the inventor license out his invention for a profit, as most licensees are interested in exclusive rights over a product. However, given the legal procedures involved in filing and being granted a patent, they are not necessary for products that are not quite unmarketable or are meant to be sold for a very small span.

Patents are most significant in a situation where the product, which has been created through hard work and expertise of an individual or a group, has fair potential in the market due to some unique advantage that it provides. If such inventions were not safeguarded through a legal framework, there would be no way to reward people who can think differently and come up with innovative ideas.
